Can I file a ski accident claim?

Yes, you can file a ski accident claim if your accident resulted from another person or entity’s negligence. Ski accident claims can be the result of injuries caused by aggressive skiers, defective equipment, injuries entering and exiting lifts, and lift operators who were either improperly trained or improperly supervised.

How common are ski and snowboarding accidents?

The American Academy of Orthopaedic Surgeons (AAOS) reports that nearly a quarter of a million people were treated for winter sports injuries in the U.S. in 2015.

Of these, about 88,000 were injuries that occurred while skiing, and about 61,000 were injured while snowboarding.

What kind of injuries can a person suffer in a ski accident?

Some of the most common ski injuries are sprains, strains, and other minor injuries. When you combine speed and heights with little protective equipment being worn by participants, more serious injuries are possible.

Broken bones, traumatic brain injuries, and spinal cord injuries that can result in paralysis can also happen when things go wrong on the slopes.

Some of these injuries result from a skier’s own negligent behavior; however, they can result if any of the following parties behave negligently:

  • The ski resort itself (e.g., failing to maintain equipment, failing to hire experienced staff members, failure to warn of hazardous conditions)
  • Equipment manufacturers (e.g., manufacturing dangerous equipment, defective ski lifts, failure to warn of dangerous conditions)
